You represent that you are legally competent under applicable law to enter into a binding contract and that the information you provide to register an account is accurate, complete and up-to-date.
You agree to maintain the confidentiality of your login credentials and accept responsibility for all activities occurring under your account.
DearYu reserves the right to suspend or terminate accounts that:
- Provide inaccurate, misleading or fraudulent information.
- Engage in improper, abusive or suspicious activity.
- Violate these Terms or any applicable laws.
2. Product Information, Pricing & Availability
We take rigorous measures to ensure that product descriptions, metal purity details, gemstone specifications, weights and pricing displayed on the Platform are accurate.
However, minor variations may occur due to:
- Handcrafted nature of jewellery,
- Screen display differences,
- Variations in gemstone characteristics,
- Inventory changes.
All prices are subject to change without prior notice.
Products appearing on the Platform may occasionally be out of stock, discontinued or available only in select regions. DearYu reserves absolute discretion in determining product availability.
3. Orders, Acceptance & Cancellations
Your order constitutes an offer to purchase a product. DearYu may accept or decline this offer at your sole discretion.
An order is deemed confirmed only when you receive a formal order acknowledgement via email or SMS.
We may cancel orders in situations including but not limited to:
- Pricing or typographical errors,
- Payment issues,
- Regulatory restrictions,
- Potential fraudulent activity,
- Product unavailability.
Where cancellations occur from our end, we will issue a full refund to the original mode of payment.
4. Payment Terms
We offer multiple secure payment options, including credit/debit cards, UPI, net banking and approved financing partners.
All payments are processed through encrypted third-party gateways compliant with applicable security standards.
By initiating a payment, you authorise the gateway to process the transaction and share transaction-related information with us solely for order fulfilment.
5. Shipping, Delivery & Ownership
Shipping timelines provided on the Platform are indicative and may vary due to factors beyond our control, such as logistical delays or regulatory checks.
Delivery shall be completed when the product is successfully handed over at your designated address.
Ownership and risk of loss transfer to you upon delivery.
If you choose to appoint a representative to collect the product on your behalf, DearYu will consider the delivery completed once the product is handed to that representative.
6. Return, Replacement & Exchange
Returns, replacements and exchanges for DearYu products are governed exclusively by our Exchange & Return Policy, which forms an integral part of these Terms.
By engaging with the Platform, you agree to abide by all conditions, timelines and eligibility criteria specified therein.
7. Use of the Platform
You agree not to use the Platform for any unlawful, abusive, disruptive or commercially exploitative activity.
Prohibited actions include, but are not limited to:
- Attempting to breach platform security,
- Copying, scraping or mining product data,
- Uploading harmful code or interfering with Platform functioning,
- Misusing promotional offers or referral programs.
DearYu reserves the right to restrict access in the event of misconduct.
8. Intellectual Property Rights
All content on the Platform, including logos, images, product designs, icons, text, graphics, digital assets, videos and software, is the exclusive property of DearYu and is protected under applicable intellectual property laws.
You are prohibited from copying, reproducing, distributing, modifying or reverse-engineering any content without our explicit written consent.
Unauthorised use will constitute a breach of these Terms and may attract legal consequences.
9. Disclaimer of Warranties
All information, products, services and content provided on the Platform are made available on an “as-is” and “as-available” basis.
While we take utmost care to ensure accuracy and reliability, DearYu makes no warranties, express or implied, regarding the uninterrupted, error-free, virus-free or precise functioning of the Platform.
This clause should be read together with our Disclaimer Policy.
10. Limitation of Liability
To the fullest extent permitted by law, DearYu shall not be liable for any:
- Indirect, incidental or consequential damages,
- Loss of data, revenue or goodwill,
- Delays, interruptions or technical failures,
- Damages arising from unauthorised access to user accounts.
Our aggregate liability, if any, shall not exceed the total amount paid by you for the specific order in question.
11. Communication & Notifications
By using our Platform, you consent to receiving transactional messages, alerts, service updates and promotional material via SMS, WhatsApp, email, push notifications or other digital channels.
You may opt out of promotional communications at any time, while transactional messages will continue as they are necessary for service fulfilment.
